These Terms of Service ("Terms") apply to the Hawpol mobile app for iOS and Android and the Hawpol website (together, the "Service"), provided by Hawpol ("we", "us"). Please read them carefully.
1. Acceptance of these Terms
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a school, you confirm that you are authorised to accept these Terms for that school.
2. Eligibility and minors
Hawpol is used by schools, and many students are under 18. Students use the Service in connection with their school.
- If you are under 18, or under the age of digital consent where you live, you may use the Service only with the permission of your parent or guardian, or through a school that has obtained any consent the law requires.
- The school, or the student's parent or guardian, is responsible for the student's use of the Service.
- Parents and guardians can contact us at any time to review or delete their child's account.
3. Accounts and roles
Each account has a role that decides what it can see and do:
- Student: views and submits homework and activities, and sees their own grades, reports, attendance, schedules and bus status.
- Teacher: publishes content to their classes or selected students, takes attendance and records grades and reports.
- School administrator: manages the school's profile, classes, subjects, members, join requests and announcements.
- Driver: sees assigned students and marks their ride status.
You must give accurate information, keep your password secret and tell us straight away if you think someone else has used your account. You are responsible for activity under your account.
4. The school's responsibilities
Each school decides who joins it, which roles they have and what content is published. For the content and personal data that a school and its teachers publish or manage in the Service, the school acts as the controller and we process that data on the school's behalf.
The school is responsible for:
- having a lawful basis, and any parental consent the law requires, for the student data it manages in Hawpol;
- the accuracy of grades, reports, attendance and other records it publishes;
- approving members and assigning the correct roles;
- making sure its staff follow these Terms.
5. Acceptable use
You agree not to:
- post content that is unlawful, harmful, threatening, harassing, hateful, sexual, violent or that bullies or exploits any person, especially a child;
- share other people's personal data without permission;
- pretend to be another person or school, or misrepresent your role;
- upload viruses or harmful code, or try to access accounts, data or systems you are not allowed to access;
- scrape, copy or resell the Service, or use it to send spam or advertising;
- break any law or the rights of others.
We and the school may remove content that breaks these rules. Please report harmful content through the app or our contact form.
6. Your content
You keep ownership of content you submit, such as homework, submissions, photos, posts and messages ("User Content").
You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your User Content only as needed to operate, secure and improve the Service and to show it to the people allowed to see it. This licence ends when the content is deleted, except for copies kept in backups for a limited time or as required by law.
You confirm that you have the rights to the User Content you submit.
7. Intellectual property
The Service, including its software, design, name and logo, belongs to Hawpol or its licensors and is protected by law. We give you a personal, non-transferable, revocable licence to use the app on devices you own or control, under these Terms. You may not copy, modify, reverse engineer or distribute the Service except where the law allows it.
8. Push notifications
The app can send push notifications about announcements, homework, grades, attendance and bus status. You can turn them off at any time in your device settings. If you do, you may miss time-sensitive updates.
9. Third-party services
The Service relies on third-party providers, such as cloud hosting, file storage and push notification services, as described in our Privacy Policy. Links to other websites or services are provided for convenience. We are not responsible for third-party services we do not control.
10. App Store and Google Play Terms
Apple App Store
If you downloaded the app from Apple's App Store, the following also applies:
- These Terms are between you and Hawpol only, not Apple Inc. ("Apple"). Hawpol, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is limited to using it on Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide any maintenance or support services for the app.
- If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are the responsibility of Hawpol.
- Apple is not responsible for handling any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property rights, Hawpol, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
Where these Terms do not cover something, Apple's Licensed Application End User License Agreement applies. Questions, complaints or claims about the app should be sent to us using the contact details below.
Google Play
If you downloaded the app from Google Play, your use of the Android app is also subject to the Google Play Terms of Service and Google's policies. Google LLC is not a party to these Terms and is not responsible for the app or its content.
11. Availability and changes to the Service
We work to keep the Service available and secure, but we cannot promise that it will always be available or free of errors. We may change, add or remove features, carry out maintenance, or stop offering the Service. If we make a major change that affects you, we will try to tell you in advance.
12. Suspension and termination
We may suspend or close an account if it breaks these Terms or the law, puts other users at risk, or if a school asks us to remove a member from that school. Where reasonable, we will tell you why. A school may also remove a member from the school at any time.
You can stop using the Service at any time. Sections that by their nature should continue after termination, such as intellectual property, disclaimers, limitation of liability, indemnity and governing law, will continue to apply.
13. Account deletion
You can delete your account in the app under Settings → Delete account, or by asking us on our account deletion page. What is deleted and what a school may keep is explained in our Privacy Policy.
14. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Schools and teachers are responsible for the educational content, grades and records they publish. Bus status is entered by drivers and may not reflect the real position of a bus at every moment. Do not rely on the Service alone in an emergency.
15. Limitation of liability
To the extent the law allows, Hawpol will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 100.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
16. Indemnity
To the extent the law allows, you agree to indemnify and hold harmless Hawpol from claims, losses and costs (including reasonable legal fees) arising from your User Content, your breach of these Terms or your misuse of the Service. This section does not apply to students who are minors.
17. Governing law
These Terms are governed by the laws of the Kurdistan Region of Iraq. The courts of the Kurdistan Region of Iraq have jurisdiction over disputes, unless the law of the country where you live as a consumer gives you the right to bring a claim in your local courts.
18. Changes to these Terms
We may update these Terms from time to time. We will change the "Last updated" date above and, for important changes, notify you in the app or by email before they take effect. If you continue to use the Service after the changes take effect, you accept the updated Terms.
